There has
been much to keep you updated upon since the half way mark of the year and

important and not particularly publicised issues that is
potentially concerning businesses is the change in regulations regarding
e-mail marketing. Originally

Many companies have
recognised e-mail as a highly productive and cost effective means of
marketing and communication. However the inclusion of an unsubscribe feature
will no longer be enough to satisfy the new Directive on Privacy and
Electronic Communications. Information from the DTI
states ‘that
unsolicited commercial e-mail (UCE) and SMS to individual
subscribers is subject to a prior consent requirement, so that it may only be
sent if the recipient has agreed in advance.
There is an exception to this rule in the context of an existing
customer relationship, where companies may continue to market their own
similar products and services on an “opt-out” basis’ That means that you need
to have obtained permission to include an individual in your mailing list,
unless that person has demonstrated an interest in your products or services
previously. You will still need to include an opt-out feature. Although guidance on the
regulations is not due to be released until early November, the current
indications interpret ‘existing customer relationship’ to include the

Prospects who have
requested brochures, quotes etc ·
